Terms & Conditions of Rental & Sale of Portable Inverters
Introduction
These Terms and Conditions (“Terms”) govern the rental and sale of portable inverters (“Products”) by Porta Power (“Company”) to its clients (“Client”) in South Africa. By renting or purchasing Products from Porta Power, the Client agrees to abide by these Terms. Please read these Terms carefully before entering into any transaction with the Company.
Definitions
a. “Client” refers to the individual or entity entering into an agreement with Porta Power to rent or purchase Products.
b. “Products” refers to the portable inverters and UPS systems offered by Porta Power.
c. “Agreement” refers to the contractual arrangement between Porta Power and the Client for the rental or purchase of Products.
Rental and Sale Options
a. Porta Power offers the following options for Clients:
i. Once-off Purchase: Clients may purchase Products outright for a one-time payment.
ii. Rental: Clients may choose to rent Products for a specified rental period as agreed upon in the Agreement.
iii. Rent-to-Own: Clients may opt for a rent-to-own arrangement, where a portion of the rental fees paid will be applied towards the purchase price of the Product. Details of the rent-to-own arrangement will be specified in the Agreement.
Rental Terms
a. Rental Period: The Client agrees to the rental period specified in the Agreement. Any extension of the rental period must be mutually agreed upon and documented in writing.
b. Rental Fees: The Client agrees to pay rental fees as per the Agreement. Payment is due in advance, and late payments may result in additional charges or termination of the rental agreement.
c. Care and Maintenance: The Client is responsible for the proper care and maintenance of the rented Products. In case of a problem with the product, contact a representative from Porta Power immediately. Any damage caused by negligence or misuse is the responsibility of the Client and may result in additional charges.
d. Return of Products: At the end of the rental period, the Client must return the Products to Porta Power in good condition, ordinary wear and tear excepted.
Sale Terms
a. Purchase Price: The purchase price for Products purchased outright will be as specified in the Agreement.
b. Payment: Payment for purchased Products is due in full before delivery or collection. Failure to make full payment may result in the cancellation of the order.
Ownership
a. Rental: Products rented by the Client remain the property of Porta Power at all times. The Client shall not claim ownership or attempt to sell, transfer, or assign the rented Products to any third party.
b. Sale: Ownership of Products purchased outright transfers to the Client upon receipt of full payment.
Warranty
- Porta Power provides a warranty on its Products, the terms and duration of which will be specified in the Agreement. Warranty claims must be made in accordance with the Company’s warranty policy.
Termination
a. Porta Power reserves the right to terminate any rental agreement or sale transaction in the event of non-payment, breach of these Terms, or any other lawful reason.
Governing Law
a. These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
Entire Agreement
a. These Terms constitute the entire agreement between the Client and Porta Power, superseding any prior agreements, understandings, or representations.
By renting or purchasing Products from Porta Power, the Client acknowledges and accepts these Terms and Conditions. The Client should seek legal advice if any part of this agreement is unclear. These Terms are subject to change, and the Client will be bound by the Terms in effect at the time of the rental or purchase.
